Instagram Food Porn Violates Copyright Law

German court recently ruled Instagram food porn violates copyright law. Essentially German copyright laws protect “elaborately arranged food.” While this has implications legally in Germany, it may have a ripple affect.

This could be bad news for folks like me who LOVE to take photos of the food I eat at restaurants and make at home. I mean let us be honest here: isn’t the whole reason for Instagram is to take and post photos of food in between selfies? And I am not even a hipster… I am just a foodie who enjoys sharing food with others. When I post photos of food on my Facebook page, I get tons of activity from friends and family.  Same thing happens when I post photos of Oppie, the kitten. #Protip: Key to Facebook success post food and cat photos. 🙂

I am pretty sure that most chefs and restaurants want people to share photos of the meals they are creating. It is the best kind of advertising… word of mouth. It only helps the restaurant. Even when the person taking the picture isn’t a professional photographer specializing in food and that photo may not be perfect or anywhere near perfect. That person is excited about the meal and wants to share.

We are just wired to love food, photograph it, and then share it. Let us share the love of food. Especially if we tag the location encouraging people to come eat at the restaurant.
